Terms of Service
Effective October 26, 2026 · X3 Contractor Prequal LLC
In plain words: X3 Contractor Prequal helps you get ready for prequalification. You stay responsible for what you submit. We never submit anything to a network for you, and nothing here is legal advice.
These Terms of Service ("Terms") cover your use of the X3 Contractor Prequal website at x3prequal.com, the free grade check, the dashboard and every related service (the "Services"). The Services are provided by X3 Contractor Prequal LLC ("X3 Contractor Prequal," "we," "us"). By creating an account or using the Services, the business you act for ("Customer," "you") agrees to these Terms.
1. What the Services do, and what they do not
The Services help contractors prepare for prequalification networks such as ISNetworld, Avetta and Veriforce and for hiring-client requirements. They estimate grade risk, list programs and records reviewers commonly expect, draft written safety programs, track certificates, training and OSHA recordkeeping, and organize hiring-client requirements.
- Not legal advice. We are not a law firm. Output, including drafted programs and AI answers, is decision support. A qualified person at your company must review, complete and sign every program before you use it.
- Not a grade. Grade risk is our estimate. Your network and your hiring client decide your grade and whether you are approved for work.
- Not affiliated. We are not affiliated with or endorsed by OSHA, ISNetworld, Avetta, Veriforce, any hiring client or any government agency. Their names are used only to describe what the Services help you prepare for.
- We do not submit for you. You decide what to upload to any network or give to any client.
2. Accounts
The Services are for business use by people authorized to act for a contractor or other employer. You are responsible for your users, for keeping sign-in details private and for keeping account information accurate. You must be at least 18 to create an account.
3. Plans, fees and renewals
Prices and plan features are as shown on the pricing page at checkout. The Grade Rescue pack is a one-time purchase. Keep-My-Grade is a monthly subscription that renews automatically each month at the then-current price until you cancel. You can cancel at any time from Plan and billing in your dashboard or by writing to support@x3prequal.com; cancellation takes effect at the end of the paid month. Payments are processed by Stripe. Fees are in U.S. dollars and are non-refundable except where the law requires a refund or these Terms say otherwise. Network membership fees charged by ISNetworld, Avetta, Veriforce or others are separate and are paid by you to them. We will give at least 30 days' notice by email before a price change applies to your subscription.
4. Your data
You own the information you put into the Services, including company details, programs, certificates, training records, OSHA logs and hiring-client lists. You give us a limited license to store and process it only to provide and improve the Services. You confirm that you have the right to submit it, including any employee information. Our Privacy Policy explains how we handle it.
Hiring-client requirements. When you list requirements for a hiring client, we may count them, without your company name or any other detail about you, to suggest requirements to other contractors who work for the same client. A suggestion appears only after at least two contractors have listed it. You can remove your entries at any time.
5. AI features
Program drafting and Ask X3 use a third-party AI model, grounded on the text of the regulations. AI output can be incomplete or wrong. The required-element check shows which parts of the regulation a draft covers, but it is not a guarantee that a program is complete or that it fits your worksite. Review everything before you rely on it.
6. Acceptable use
- No unlawful use, and no false information submitted to a network or client with the Services' help.
- No uploading information you are not allowed to share, including other people's personal information without authority.
- No attempts to break, overload, copy, reverse-engineer or get around the security of the Services.
7. Intellectual property
We own the Services, the software, the rules and checklists, and the requirement library. Programs drafted for you are yours to use, change and share for your business once you have paid for them. Feedback you send us may be used without restriction.
8. Confidentiality
Each side will protect the other's confidential information and use it only for these Terms.
9. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not promise that the Services will be error-free, that you will reach any grade, or that output will meet any law, network or client requirement.
10. Limitation of liability
To the fullest extent the law allows, neither side is liable for indirect, incidental, special or consequential damages, including lost work or lost contracts. Our total liability arising out of the Services will not exceed what you paid us in the twelve (12) months before the event that led to the claim.
11. Indemnification
You will defend and indemnify us against third-party claims that come from your unlawful use of the Services or your breach of sections 4 or 6. We will defend and indemnify you against third-party claims that the Services infringe intellectual-property rights.
12. Ending the agreement
You may stop using the Services and close your account at any time. We may suspend or end access for a material breach of these Terms. After an account closes you have 30 days to download your data; after that we delete it as described in the Privacy Policy.
13. Governing law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Exclusive venue lies in the state courts in Livingston County, Michigan, and the United States District Court for the Eastern District of Michigan, and each side waives a jury trial.
14. Changes
We will email the account owner at least 30 days before a material change to these Terms takes effect, and you may cancel before then if you do not agree. Other updates are posted here with a new effective date.
15. Whole agreement
These Terms and the Privacy Policy are the whole agreement about the Services. Neither side may assign these Terms without the other's written consent, except to a successor in a merger or a sale of the business.
